According to the Assam Panchayat  Act, 1994, for every district, there will be a Zilla Parisad. This Zilla Parisad would have jurisdiction over entire area within the district except the areas which are included in a Municipality, Municipal Corporation, Town Committee or cantonment area. Every Zilla Parisad shall be a body corporate by the name of “Zilla Parisad” . 

Composition : 

     The Zilla Parisad contains three types of members :

a. The members directly elected from the territorial constituencies of the district. 

b. Presidents of the Anchalik Panchayats.

c. Members of the Lok Sabha and State Legislative  Assembly representing a part or whole of the district lie within the Zilla Parisad.

      In Zilla Parisad seats are reserved for SC/ST and the number of seats shall bear the same proportion to the total number of seats to be filled up from amongst the directly elected members in Zilla Parisad.

       In Zilla Parisad not less than one-third of the total number of seats shall be reserved for woman and such seats may be allotted by rotation to different constituencies under the Zilla Parisad

     If woman from general category and woman from SC/ST are not represented in Zilla Parisad, the Government by notification may nominate one member from such category.

Staffs of Zilla Parisad : 

       The Government appoints an officer not below the rank of the Additional Deputy Commissioner of the district as Chief Executive officer of Zilla Parisad beside Chief Executive officer, the Government posts from time to time to work under every Zilla Parisad considering necessity, such number of other officers of state government.

   The Chief Executive Officer is responsible for carrying out the policies, direction of Zilla Parisad and to take necessary steps for the speedy execution of the policies, programmes. 

      He supervises the works of the officers and employees of Zilla Parisad. He has custody of all papers, documents of Zilla Prisad. He draws and disburse money out of the District Rural Development Funds. He is the ex-officio secretary of Zilla Parisad. 

Duration : 

     Zilla Parisad is elected for a term of 5 years. New Zilla Parisad must be constituted before the expiry of duration of existing Zilla Parisad

      If it is dissolved, new Zilla Parisad must be formed within 6 months from the date of such dissolution. 

The President and the Vice-President : 

      After the formation of Zilla Parisad the Deputy Commissioner calls a meeting of the Zilla Parisad to elect the President and a Vice-President among the directly elected members. Any dispute regarding the election of President or Vice-President shall be solved by the State Government or State Election Commission. They are elected for a term of 5 years. The President may resign from his office by writing to Government through Deputy Commissioner. 

      The directly elected members of Zilla Parisad may pass no-confidence motion against the President or the vice President, with the two-third majority vote. 

       The President and Vice-President may be removed from the office by the State Government on charges of misconduct in the discharge of the duties, neglect, incapacity to perform duties, for being persistently remiss in the discharge of or guilty of any disgraceful conduct. Once so removed, the president or Vice-President is not eligible for re-election. 

      Every Zilla Parisad shall hold meetings at least once in every three months. The President may convene a special meeting with the writing of one-third members of Zilla Parisad. Every member of Zilla Parisad has the write to vote. One-third of the total numbers of members of the  Zilla Parisad would form a quorum to transact business at the meeting of Zilla Parisad

      All question coming before Zilla Parisad meeting shall be decided by majority votes. No resolution of the Zilla Parisad shall be modified or cancelled within six months after the passing of it, except by a resolution passed by not less than one half of the total number of members at the ordinary or special meeting. 

      In the absence of  the President , Vice-President presides over it. In case of the absence both, the members elect one from among themselves to preside. 

Powers and function of President and Vice-President : 

     The President shall : -

a. Convene, preside over and conduct the meetings of Zilla Parisad.

b. Exercise administrative supervision over the Chief Executive Officer and discharge other duties entitled by the Zilla Parisad or the government.

c. Exercise over-all supervision over the financial and executive administration of the Zilla Parisad and place before it all the questions connected with financial and executive administration.

     The Vice-President, in absence of the President will perform functions, duties of the President. 

Standing Committees : 

      For smooth and efficient functioning of Zilla Parisad, it may have following Standing Committees. 

    For Example :-

a. General Standing Committee,

b. Financial and Audit Committee,

c. Social Justice Committee,

d. Planning and Development Committee.

    The total strength of Standing Committees should not be more than five including the Chairman. The President would act as Chairman of General Standing Committee and Financial and Audit Committee. The other two committees shall elect their Chairman among themselves. No member of Zilla Parisad can serve two standing committees at the same time. 

     The Chief Executive Officer of the Zilla Parisad would act as an ex-officio secretary of the General Standing Committee and Finance, Audit and Planning Committees. 

      He may nominate two Deputy Secretaries for the other two Standing Committees. The Chief Executive Officer has the authority to attend the meetings of all Standing Committees. 

       The General Standing Committee deals with the establishment matters and functions relating to communication, buildings, rural housing, village extension, relief in case of natural calamities.

       As the name suggest, the Finance and Audit Committee deals with the Finance of Zilla Parisad preparing the Budget, scrutinising proposals for increase of revenue; examination of receipts and expenditure; consideration of the proposals effecting the Finance of Zilla Parisad and general supervision of the and expenditure of Zilla Parisad. 

    The Social Justice Committee is concerned with social issues, e.g. promotion of educational, economic, social, cultural and other interests of the SC/ST and other backward classes; to protect them from social injustice and all forms of exploitation etc.

      The Planning and Development Committee tries to develop the whole area under the jurisdiction of Zilla Parisad in a planned manner. 

     It is the in-charge of all educational activities of Zilla Parisad. It undertakes the educational planning for the district in compliance with the National Policy. It performs the duties relating to adult literacy, cultural activity of Zilla Parisad etc.

Powers and Functions of Zilla Parisad :  

     The Government may assign to Zilla Parisad any function over which the State Government enjoy executive authority or any functions which has been assigned by the Central Government to State Government. 

     At the same time the government may withdraw or modify these functions. The Zilla Parisad has the power to acquire, hold and dispose of property and to enter into contracts. All the roads or other works done by Zilla Parisad with its own fund shall be vested in it. 

       The State Government may also allocate to Zilla Parisad public property within the jurisdiction of it. The Zilla Parisad has the power to divert, discontinue or permanently close any road which is under the control of Zilla Parisad. 

      The Zilla Parisd has power to incur expenditure on education or medical relief outside its jurisdiction. It may render financial assistance to any person within its own jurisdiction to carry out any function connected with the state. 

       The Zilla Parisad is responsible for the preparation of planes for economic development and social justice and for ensuring co-ordinated implementation of such planes. 

     All planes should be made considering the following aspects : 

a. Social Forestry : 

      Organise campaign for tree planting and maintenance; promotion of social and farm forestry; fuel plantation and fodder development; management of minor forest products etc.

b. Agriculture :  

    Promotion of measures to increase agricultural production and to popularise use of improved agricultural implements and practices; opening and maintenance of Agricultural firms and making agencies; conducting agricultural fairs and exhibitions to encourage the farmers; management of agricultural and horticultural extension of training centres; training of farmers; measures for land improvement and soil conservation.

c. Rural Housing : 

    Identification of homeless families; implantation of house building programmes popularisation of low cost housing.

d. Social Reform Activities : 

    Establishment of women’s and children’s organisations and welfare, maintenance of social welfare institution; sanctioning and distribution of pension for widows, old and physically disabled, destitute , etc. 

e. Poverty Alleviation Programme : 

    Planning, supervising, monitoring and implementing the poverty alleviation programmes. 

f. Health and Hygiene : 

      To establish and maintain of hospitals, primary health centres, dispensaries; to implement immunisation and vaccination programmes; to organise health education activities; family welfare activities; to take measures against environmental pollution. 

g. Rural Electrification : 

     Assistance in the implementation and maintenance of rural electrification scheme. 

h. Soil Conservation : 

      To take soil conservation measures, land reclamation and land development works. 

i. Horticulture : 

     Establishment of Rural parks and gardens ; cultivation of fruits and vegetables.

j. Marketing : 

    To develop the regulated markets and marketing yards; grading and quality control of Agricultural product.

k. Rural Roads and Inland Waterway :

      Construction and maintenance of roads except National and State highway; identification of major Link roads connecting markets, educational institutions, health centres, hospitals etc. ; construction and maintenance of office building of Zilla Prisad etc.

l. Education, including social welfare and welfare of weaker section : 

      Promotion of educational activities including establishment and maintenance of primary and secondary schools; planning of programmes for adult education and library facilities; organising nursery school , high school etc. ; to eradicate illiteracy and impart general education; managing hostels for the benefit of  SC/ST; survey and valuation of educational activities; providing facilities for marketing of goods produced by members of SC/ST; other welfare schemes for the upliftment and development of SC/ST etc.

Zilla Parisad Fund : 

    Every Zilla Parisad has its own fund called Zilla Parisad Fund. 

     It containing : -

i. The amount transferred to Zilla Parisad fund from consolidated fund of state ;

ii. All grants, assignment, loans, contributions made by the government ;

iii. All fees and penalties collected by Zilla Parisad ;

iv. All rent from land or other properties of Zilla Parisad ;

v. All interests, profits securities etc. of Zilla Parisad.

       The money of this fund is used for the preparations and implementation of plans for economic development and social justice. The allowances of the President and Vice-President are also incurred from this fund.

Sources of Revenue :  

     Zilla Parisad may charge fee for any licence or permission issued by it. It may  levy rent and fees for the use of the land or other property of Zilla Parisad

      It may levy tolls in respect of any ferry established and managed by it. It may charge fee for providing sanitary facilities in the places of worship, melas. It may collect water rate, lighting rate etc.


Budget : 

     The Zilla Parisad prepares its budget and submits it to Government through the Director of Panchayat and Rural Development, Assam. The Government may pass the budget or may return it to Zilla Parisad with some modifications. 

     If the budget is not approved within thirty days of the submission, it would be considered as passed by the Government. No expenditure can be incurred without the approval of budget. 

Accounts and Audit : 

      The Zilla Parisad has to maintain its accounts and submit it for audit. Audit is conducted by the authority prescribed by the Government and a copy of the audit report should be forwarded to the Zilla Parisad within one month of the completion of the audit.
